**General Terms and Conditions for the Online Ticket Shop of YONTEX GmbH & Co. KG (hereinafter referred to as "Online Ticket Shop Terms and Conditions")
Status July 2024**
1. scope of application
The General Terms and Conditions Online Ticket Shop of YONTEX GmbH & Co. KG are an integral part of the contracts concluded between YONTEX GmbH & Co. KG (hereinafter referred to as "YONTEX") and the customer (hereinafter referred to as "Customer") with regard to the ordering and delivery of goods and tickets. They shall apply exclusively unless otherwise agreed in writing. Any deviating general terms and conditions of the customer shall not apply.
2. orders / conclusion of contract
(1) The goods and tickets offered by YONTEX in the online ticket shop constitute a non-binding invitation to the customer to order them from YONTEX. Only by placing an order does the customer make a binding offer to conclude a contract. YONTEX accepts the customer's offer to enter into a contract, subject to the availability of the goods and tickets, by sending the customer an order confirmation by e-mail. In principle, there is no right of return or refund for ordered goods and tickets. If YONTEX realises during the processing of the order that the ordered goods or tickets are not available, you will be informed separately by e-mail.
(2) In the case of trade fairs, YONTEX reserves the right to issue tickets exclusively to trade visitors and to monitor this trade visitor status appropriately. Tickets for trade fairs may not be resold or otherwise transferred to third parties without the prior written consent of YONTEX.
(3) In the case of trade fairs, the order can also be placed for a named third party. In this case, apart from the telephone number, fax number and e-mail address, all personal data of this third party shall be recorded. The third party's structural data will also be requested and recorded. By placing the order, the customer assures that he is sufficiently authorised to pass on this data of the third party.
3. terms of payment and prices
(1) Payment for goods and tickets is made by credit card.
(2) Unless otherwise agreed, the prices quoted by YONTEX shall be in euros including statutory VAT.
4th availability
As a rule, the customer is authorised to order unlimited tickets. If this is not the case, the restriction is noted with the corresponding product.
5th delivery
After receipt of the order, the customer will receive a confirmation email for tickets and at the same time PDF files for printing the tickets using the print@home method or for saving on mobile devices, even if the order is placed for a third party. The tickets are also stored in the customer's user account as a mobile ticket (Passbook / Wallet).
6. liability
(1) The customer is obliged to check the tickets for correctness and completeness immediately after delivery and to notify Messe Frankfurt of any complaints immediately in writing or by e-mail. Otherwise, the statutory liability for defects shall apply.
(2) YONTEX shall be liable without limitation insofar as the cause of the damage is based on an intentional or grossly negligent breach of duty by YONTEX.
(3) Furthermore, YONTEX shall be liable for the slightly negligent breach of material obligations, the breach of which jeopardises the achievement of the purpose of the contract, or for the breach of obligations, the fulfilment of which is essential for the proper performance of the contract and on the observance of which the customer can regularly rely. In this case, however, YONTEX shall only be liable for foreseeable damage typical of the contract. YONTEX shall not be liable for the slightly negligent breach of obligations other than those mentioned in the preceding sentences.
(4) The above limitations of liability shall not apply in the event of injury to life, limb or health or in the event of fraudulently concealed defects.
(5) Insofar as YONTEX's liability is excluded or limited, this shall also apply to the personal liability of YONTEX's employees, representatives or vicarious agents.
7. data protection notice on lead tracking
If the customer participates in lead tracking, the contact data provided by the customer during visitor registration (company name, title, surname, first name, company, street, postcode, city, e-mail, industry information if applicable and other information provided by the customer) will be transmitted to the exhibitor, regardless of whether the exhibitor is from Germany, the EU or other third countries.
Participation in lead tracking takes place when the customer authorises an exhibitor to scan the barcode on their ticket for the event during their visit. Similar to handing over a business card, the above-mentioned data is transmitted to the exhibitor by scanning the barcode. Participation in lead tracking is voluntary and does not take place without further co-operation from the customer.

8 Place of fulfilment and jurisdiction
(1) The place of fulfilment and jurisdiction for all obligations arising from the contractual relationship is Nuremberg, provided that the client is a merchant, a legal entity under public law or a special fund under public law or has no general place of jurisdiction in Germany.
(2) German law and the German text of these General Terms and Conditions shall apply exclusively. The provisions of the UN Convention on Contracts for the International Sale of Goods shall not apply.
9. changes to the conditions of sale
YONTEX reserves the right to make changes to the website, rules and conditions, including these General Terms and Conditions, at any time. Your order will be subject to the terms and conditions in effect at the time the order is placed, unless a change to these terms and conditions is required by law or governmental order.

Copyright YONTEX GmbH & Co KG, Nuremberg (Germany). All rights reserved. All texts, images, graphics, video, animation and sound files as well as their arrangements on the website are subject to copyright and other laws for the protection of intellectual property. These rights, as well as the content of our website, may not be copied, modified or used on other websites for commercial or industrial purposes or for distribution. 11. severability clause
Should a provision of these General Terms and Conditions Online Ticket Shop or a provision within the framework of other agreements be or become invalid, this shall not affect the validity of all other provisions or agreements or the contractual relationship between the parties. In this case, the customer together with YONTEX shall replace the invalid provision by a valid provision which comes closest to the economic purpose of the invalid provision.

The cancellation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the goods. by means of a clear statement (e.g. a letter sent by post, fax or e-mail) of your decision to cancel this contract. You can use the attached sample cancellation form, but this is not mandatory. You can also electronically complete and submit the model cancellation form or another clear declaration on our website www.nuernbergmesse.de/widerruf. If you make use of this option, we will immediately send you a confirmation of receipt of such a cancellation (e.g. by e-mail). In order to comply with the cancellation period, it is sufficient for you to send the notification of the exercise of the right of cancellation before the expiry of the cancellation period.
Consequences of cancellation
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this repayment. We may withhold reimbursement until we have received the goods back or until you have supplied evidence of having sent back the goods, whichever is the earliest. You must return or hand over the goods to us immediately and in any case within fourteen days at the latest from the day on which you inform us of the cancellation of this contract. The deadline is met if you dispatch the goods before the period of fourteen days has expired. You shall bear the direct costs of returning the goods. You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking their condition, properties and functionality.

(2) Exclusion of the right of cancellation

The General Terms and Conditions Online Press Ticket Shop of YONTEX GmbH & Co. KG are an integral part of the contracts concluded between YONTEX GmbH & Co. KG (hereinafter referred to as "YONTEX") and the media representative / blogger (hereinafter referred to as "Customer") with regard to the ordering and sending of press tickets. They shall apply exclusively unless otherwise agreed in writing.Any deviating general terms and conditions of the customer shall not apply.
2. orders / conclusion of contract
(1) The YONTEX press tickets offered in the online press ticket shop constitute a non-binding invitation to the customer to apply for accreditation with YONTEX. Only by applying for accreditation does the customer submit a binding offer for accreditation. YONTEX accepts the customer's application after checking compliance with its accreditation guidelines by sending him an accreditation confirmation by e-mail. If YONTEX discovers during the processing of the application that the accreditation guidelines have not been complied with or that further evidence is required, you will be informed separately by e-mail.
(2) In the case of trade fairs, YONTEX reserves the right to issue press tickets exclusively to specialised media representatives and to check this status appropriately (in particular by presenting a press card and other evidence relating to the trade fair topic). Press tickets for trade fairs may not be passed on or transferred to third parties in any other way.
3. data protection notice on lead tracking
If the customer participates in lead tracking, the contact details provided by the customer during visitor registration (company name, form of address, title, surname, first name, company, street, postcode, city, email, industry information if applicable and other details provided by the customer) will be transmitted to the exhibitor, regardless of whether the exhibitor is from Germany, the EU or other third countries. Participation in lead tracking takes place when the customer authorises an exhibitor to scan the barcode on their ticket for the event during their visit to the event. Similar to handing over a business card, the above-mentioned data is transmitted to the exhibitor by scanning the barcode.
Participation in lead tracking is voluntary and does not take place without further co-operation from the customer.

4. admission requirements
The "General Accreditation Guidelines for Journalists at Trade Fairs in Germany" of YONTEX apply.

If all accreditation requirements are met, the customer will receive a confirmation notification by e-mail and at the same time PDF files for printing out the tickets using the print@home method or for saving on mobile devices. The tickets are also stored in the customer's user account as a mobile ticket (Passbook / Wallet).
