Online Ticket Shop Terms and Conditions
General Terms and Conditions for the Online Ticket Shop of YONTEX GmbH & Co. KG (hereinafter “Online Ticket Shop T&Cs”)

1. Scope of Application
These Online Ticket Shop Terms and Conditions of YONTEX GmbH & Co. KG (hereinafter “YONTEX”) form part of the contracts concluded between YONTEX and the purchaser (hereinafter “Purchaser”) regarding the ordering and delivery of goods and tickets. They apply exclusively unless otherwise agreed in writing. Any differing general terms and conditions of the Purchaser shall not apply.
2. Orders / Conclusion of Contract
(1) The goods and tickets offered in the YONTEX online ticket shop constitute a non-binding invitation to the Purchaser to place an order with YONTEX. Only by placing an order does the Purchaser submit a binding offer to conclude a contract. YONTEX accepts the Purchaser’s contractual offer, subject to availability of the goods and tickets, by sending an order confirmation via email. As a rule, there is no right of return or refund for ordered goods and tickets.For customers who are consumers within the meaning of Section 13 of the German Civil Code (BGB), there is no right of withdrawal pursuant to Section 355 BGB for tickets in accordance with Section 312g (2) No. 9 BGB. If YONTEX determines during the processing of the order that the ordered goods or tickets are not available, the Purchaser will be informed separately by email.
(2) For trade fairs, YONTEX reserves the right to issue tickets exclusively to trade visitors and to appropriately verify this trade visitor status. Tickets for trade fairs may not be resold or otherwise transferred to third parties unless YONTEX has granted prior written consent.
(3) For trade fairs, orders may also be placed for a specifically named third party. In this case, all personal data of the third party, except telephone number, fax number and email address, will be collected. Structural data of this third party will also be requested and recorded. By placing the order, the Purchaser confirms that they are sufficiently authorized to provide these data of the third party.
3. Payment Terms and Prices
(1) Payment for goods and tickets shall be made by credit card.
(2) Unless otherwise agreed, the prices indicated by YONTEX are stated in euros and include statutory VAT.
4. Availability
As a rule, the Purchaser is entitled to order an unlimited number of tickets. If this is not the case, the limitation will be indicated with the respective product.
5. Delivery
After receipt of the order, the Purchaser – also in the case of orders for a third party – will receive a confirmation by email for the tickets along with PDF files for printing the tickets using the print@home procedure or for saving them on mobile devices. The tickets will also be stored in the Purchaser’s user account as a mobile ticket (Passbook / Wallet).
6. Liability
(1) The Purchaser is obliged to check the tickets immediately after delivery for correctness and completeness and to report any complaints immediately to the trade fair organizer in writing or by email. Otherwise, the statutory warranty provisions apply.
(2) YONTEX shall be liable without limitation if the cause of the damage is based on an intentional or grossly negligent breach of duty by YONTEX.
(3) Furthermore, YONTEX shall be liable for the slightly negligent breach of essential obligations whose violation jeopardizes the achievement of the purpose of the contract, or for the breach of obligations whose fulfillment makes the proper execution of the contract possible in the first place and on whose compliance the Purchaser may regularly rely. In this case, however, YONTEX shall only be liable for the foreseeable damage typical of the contract. YONTEX shall not be liable for the slightly negligent breach of obligations other than those mentioned above.
(4) The above limitations of liability shall not apply in cases of injury to life, body or health or in the event of fraudulently concealed defects.
(5) Insofar as the liability of YONTEX is excluded or limited, this shall also apply to the personal liability of employees, representatives or agents of YONTEX.
7. Data Protection Notice regarding Lead Tracking
If the visitor participates in so-called lead tracking, the contact data provided during visitor registration (company name, salutation, title, surname, first name, company, street, postal code, city, email, if applicable industry information and other information provided by the purchaser) will be transmitted to the exhibitor, regardless of whether the exhibitor is located in Germany, the EU or other third countries.
Participation in lead tracking occurs when the visitor allows an exhibitor to scan the barcode on their ticket during their visit to an event. Similar to handing over a business card, the above-mentioned data are transmitted to the exhibitor by scanning the barcode. Participation in lead tracking is voluntary and will not take place without further action by the visitor.

8. Place of Performance and Jurisdiction
(1) The place of performance and jurisdiction for all obligations arising from the contractual relationship shall be Nuremberg, provided that the Purchaser is a merchant, a legal entity under public law, a special fund under public law, or has no general place of jurisdiction in Germany.
(2) German law shall apply exclusively and the German version of these Terms and Conditions shall prevail. The provisions of the UN Convention on Contracts for the International Sale of Goods (CISG) shall not apply.
9. Changes to the Terms of Sale
YONTEX reserves the right to make changes to the website, regulations, conditions and these Terms and Conditions at any time. The Terms and Conditions in force at the time the order is placed shall apply to the order unless a change to these conditions is required by law or by official order.

11. Severability Clause
Should any provision of these Online Ticket Shop T&Cs or any provision within other agreements be or become invalid, this shall not affect the validity of the remaining provisions or agreements or the contractual relationship between the parties. In such case, the Purchaser and YONTEX shall replace the invalid provision with a valid provision that comes closest to the economic purpose of the invalid provision.
12. Withdrawal Policy and Model Withdrawal Form

You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.
To exercise your right of withdrawal, you must inform us:

by means of a clear declaration (e.g. a letter sent by post or email) of your decision to withdraw from this contract. You may use the attached model withdrawal form, but this is not mandatory.
Effects of Withdrawal
If you withdraw from this contract, we shall reimburse all payments received from you, including delivery costs (with the exception of additional costs resulting from your choosing a type of delivery other than the least expensive standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we receive notification of your withdrawal from this contract.
For this repayment we will use the same means of payment that you used for the original transaction unless expressly agreed otherwise with you; in no event will you be charged any fees for this repayment.
We may withhold reimbursement until we have received the goods back or until you have provided proof that you have returned the goods, whichever occurs earlier.
You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you inform us of the withdrawal from this contract. The deadline is met if you send the goods before the fourteen-day period has expired.
You will bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods if this loss of value is due to handling of the goods that is not necessary for checking their nature, characteristics and functioning.

(2) Exclusion of the Right of Withdrawal
The right of withdrawal does not apply to the following contracts:
Contracts for the provision of services in the areas of accommodation for purposes other than residential purposes, transport of goods, car rental, supply of food and beverages, and for the provision of other services related to leisure activities if the contract provides for a specific date or period of performance (Section 312g (2) sentence 1 no. 9 BGB).
General Terms and Conditions for the Online Press Ticket Shop of YONTEX GmbH & Co. KG

1. Scope of Application
These Online Press Ticket Shop Terms and Conditions of YONTEX GmbH & Co. KG form part of the contracts concluded between YONTEX and the media representative / blogger (hereinafter “purchaser”) regarding the ordering and delivery of press tickets. They apply exclusively unless otherwise agreed in writing. Any differing terms and conditions of the purchaser shall not apply.
2. Orders / Accreditation
(1) The press tickets offered in the online press ticket shop constitute a non-binding invitation to the purchaser to apply for accreditation with YONTEX. By submitting an application, the purchaser makes a binding offer to obtain accreditation. YONTEX accepts the application after verifying compliance with its accreditation guidelines by sending an accreditation confirmation via email. If YONTEX determines during the review process that the accreditation guidelines have not been met or further evidence is required, the applicant will be informed separately by email.
(2) For trade fairs, YONTEX reserves the right to issue press tickets only to relevant media representatives and to verify this status appropriately (in particular by requesting a press card and further evidence relating to the trade fair topic). Press tickets may not be transferred or passed on to third parties.
3. Data Protection Notice regarding Lead Tracking
If the journalist participates in so-called lead tracking, the contact data provided during registration (company name, salutation, title, surname, first name, company, street, postal code, city, email, if applicable industry information and other information provided by the journalist) will be transmitted to the exhibitor, regardless of whether the exhibitor is located in Germany, the EU or other third countries.
Participation in lead tracking occurs when the journalist allows an exhibitor to scan the barcode on their ticket during their visit to an event. 4. Admission Requirements
The “General Accreditation Guidelines for Journalists at Trade Fairs in Germany” of YONTEX shall apply.
5. Delivery
If all accreditation requirements are met, the purchaser will receive a confirmation email together with PDF files for printing the tickets using the print@home procedure or for saving them on mobile devices. The tickets will also be stored in the purchaser’s account as mobile tickets (Passbook / Wallet).
